Glendevon Stables Breeding Contract to Glendevon's
Mountain Man Mare Owner_____________________________ does hereby book the mare, _____________________________ to the stallion, GLENDEVON’S MOUNTAIN MAN owned and managed by Leslie Deering and Glendevon Stables (hereinafter known as stallion owner) for the 2005 breeding season. There is a $150 booking fee, wholly earned and non-refundable, payable, and due with this contract. This contract includes the first collection of semen ONLY. ALL SUBSEQUENT COLLECTION FEES ($85 each), and ANY shipping or transporting of semen from Shamrock Farms to the mare are to be paid by mare owner prior to further collection/service. All costs of shipping the semen from Shamrock Farms, to Mare owner’s facility will be borne by Mare owner. MARE OWNER IS FULLY RESPONSIBLE FOR SETTING UP ACCOUNT WITH FEDERAL EXPRESS (1.800.463.3339) Mare owner understands that requests for semen collection and shipments must be made by contacting stallion owner, at 301-706-4642 by 8pm EST the day before shipment is needed. Additionally, follow up with email, and /or fax is strongly encouraged. A return confirmation from stallion owner must be received by mare owner, in order to assure communication, and guarantee that stallion is collected on the desired date. The fax number is (410) 775-0262. LIVE FOAL GUARANTEE: The stud fee of $______ is due in full to stallion owner before semen is shipped or mare is bred. (Please contact stallion owner for any discounts/consideration that may apply.) This stud fee guarantees a live foal from this mating, meaning the foal shall stand and nurse without assistance for 48 hours. This guarantee will apply ONLY if stallion owner is notified within 48 hours of foal's death. This clause is binding also in case of abortion. Statement by licensed Veterinarian must follow within ten days or guarantee becomes null and void. Foal Guarantee: Should the mare fail to conceive, die, or not produce a live foal within the 2005 breeding season, and collections have been made, the mare owner shall have the option of re-breeding the mare or a substitute mare (upon written approval of stallion owner) during the following 2 breeding seasons, for an additional booking fee of $150.00, and all expenses. Stallion Owner and Shamrock Farms assumes responsibility only to deliver semen in viable condition at the time of delivery. They are not responsible for any delays or failures in semen delivery outside of their immediate control. The mare owner accepts and assumes the risks of delayed or lost shipments, although stallion owner and Shamrock Farms will do everything in their power to assist the mare owner in completing shipment. It is our shared goal to settle the mare safely in foal, in a timely manner. The semen MUST be administered by a licensed Veterinarian familiar with the concept and practical use of equine semen. The mare owner also guarantees that semen will be used only on the mare named in this contract. PLEASE NOTE THAT NOT EVERY MARE IS A SUITABLE CANDIDATE FOR A LIVE FOAL GUARANTEE PROGRAM. IF MARE INFORMATION FORM INDICATES THAT YOUR MARE IS NOT A GOOD RISK FOR THIS PROGRAM WE WILL RETURN ANY CHECKS UNCASHED AND WILL NOT ACCEPT THIS CONTRACT. Stallion owner reserves the right to refuse service to any mare or cancel this agreement if said mare is a habitual aborter, has been bred any two consecutive years without producing a live foal, becomes ill, injured, or is improperly cared for. In such case, the stud fee (less booking fee and expenses) shall be refunded to mare owner or stallion owner may then, with written approval, allow substitution of another mare. The mare owner will ensure that the mare is examined by a veterinarian for pregnancy at or around 14-21 days after insemination. (This is the time to check for twins.) The mare owner is responsible for informing stallion owner of the pregnancy status of the mare at this time. A 45-60 day pregnancy check is strongly recommended, but not required. Mare owner will ensure that the mare is properly cared for and will receive all necessary deworming, vaccinations (including Pneumabort K vaccination at 5,7, and 9 months of gestation), and veterinary care during pregnancy. Failure to comply will void the Live Foal Guarantee. In the event the above-named stallion dies or becomes unfit for service before a collection is made, this contract shall become null and void and the booking fee, stud fee and container/shipping deposits will be returned. In the event the above-named stallion dies or becomes unfit for service after collection(s) has/have been made and the mare is confirmed not in foal, this contract shall become null and void and the stud fee and container/shipping deposit (less any shipping and expenses) will be returned. If the mare should die before any collections are made, stallion owner will refund all fees. Veterinary certificate confirming loss is required. Mare owner agrees to return the semen shipping container to SHAMROCK FARMS at Mare owner's expense within ONE WEEK from the date of receipt of the container. Failure to return container within the time limit will result in forfeiture of the deposit and will jeopardize future shipments. Container must be insured by Mare owner for a value of $50 on its return shipment. The $85 deposit, will be refunded upon return of insemination certificate signed by veterinarian, at conclusion of breeding season, provided container has been returned and all other collection fees, and/or charges have been paid in full. Breeding season for transported semen is March 15 through August 15. The mare owner will have the sole responsibility of determining the optimal breeding dates for the mare within these dates. Stallion owner will arrange to collect, analyze, package, and ship sufficient chilled semen for one breeding cycle to meet mare owner's breeding schedule provided they are notified by 8 pm the day before semen is needed. Stallion owner will try to meet the needs of the mare owner, but will not be held responsible for failure to do so. Stallion owner reserves the right to charge an additional collection fee if proper notice is not given. Mare owner realizes and accepts that the stallion may be shown during the course of the breeding season, and might on occasion be unavailable for collection. The mare owner is encouraged to alert stallion owner to anticipated 1st day of desired breeding cycle, and to check on the availability of the stallion. IT IS OUR SHARED GOAL TO SETTLE THE MARE SAFELY IN FOAL IN A TIMELY MANNER. There will be only ONE breeding certificate issued with this contract, after full payment of all fees and expenses, and return of veterinarian's completed insemination certificate showing the mare to be in foal. The breeding certificate is for the mare described in this contract. Mare owner is responsible for any desired registration of the foal. At this time, Glendevon’s Mountain Man is only registered with The Performance Horse Registry (# 4060478). Mare owner shall assume ALL RESPONSIBILITY for the condition of his/her mare and shall bear all risk of loss or damage to the mare whether by death, disease, injury, infection, or otherwise, therefore agrees hold harmless stallion owner and Shamrock Farms from any damages. MARE OWNER SHALL PROVIDE BEFORE ACCEPTANCE OF CONTRACT BY STALLION AGENT:
The Federal Express account number and information, if semen will not be picked up from Shamrock Farms. This agreement represents the entire agreement between the parties. No other agreements or promises, verbal or implied, are included, unless specifically stated. This contract is made and entered into the state of Maryland and will be interpreted under the laws of this state. This contract is non-assignable and non-transferable. This contract has been executed in duplicate and when signed by both parties will be a binding contract on both parties, subject to the above terms and conditions.
